Terms of service

Last updated: 27 October 2026

These terms apply when you use Dapply Solutions ("we", "us") to host websites and web applications. You accept them, and our acceptable use policy, when you create an account, and again when we change them.

1. The service

We host websites and web applications on servers we manage, with the resources of the plan you choose: memory, processing time, storage, a database if selected, an HTTPS certificate and nightly backups. The service is delivered online and is available as soon as your site is created; nothing is shipped.

2. Your account

You must be at least 18, give accurate and complete details, and keep your password safe. You are responsible for everything done through your account. We review new accounts before they can create sites, and may ask you to confirm who you are or your business details (for example an ID or company registration document) before approving an account or at any time afterwards. We may decline or close an account for any lawful reason, including where details cannot be confirmed. One person or business may not open several accounts to get around limits, prices or a suspension.

3. Acceptable use and fair use

Your use of the service must follow our acceptable use policy. Each plan's resources are shared fairly with other customers on the same servers: a site that uses far more processing, storage or traffic than an ordinary website of its plan, or that harms the service for others, may be limited, and we will ask you to move to a bigger plan or reduce its use.

4. Prices and payment

Prices are per site, in South African rand, as shown in our pricing. Each site is billed monthly, or yearly: twelve months paid in advance for the price of 10. At the start of each month you receive an invoice for every site billed that month, due 7 days after it is issued, payable by card through Yoco or by bank transfer. A monthly site created during a month is charged for the days left in that month; a yearly site for its year from that month. If that month's invoice is already paid, the charge goes on a new invoice. A yearly site is billed again in the month its year ends, unless you switch it to monthly billing or delete it first. Until your first payment your account can have one site, and when card payment is available that site goes live once its first invoice is paid. We give at least 30 days' notice of any price change.

5. Late payment

If an invoice is still unpaid 7 days after its due date (on the due date itself if you have not paid us before), we may pause your sites until it is paid: visitors see a notice that the site is unavailable, and your files and databases are kept. Your account shows the date before this can happen, and paused sites come back within minutes of payment. If an account stays unpaid for 60 days after a site was paused, we may close the account and delete its sites and data. You remain liable for amounts owed, and for reasonable costs of collecting them. If you dispute a valid card payment with your bank, we may suspend your account until the matter is resolved.

6. Suspension and termination

We may suspend a site or account straight away, without notice, where we reasonably believe it breaks these terms or the acceptable use policy, is unlawful, puts our servers, other customers or third parties at risk, or where the law or an authority requires it. Where the matter can be put right, we tell you what is wrong and restore the service once it is. For serious or repeated breaches we may close the account. Fees already paid for a period in which the service was suspended or closed because of your breach are not refunded.

7. Cancelling

You can cancel at any time by asking to delete your sites in your account; we confirm each deletion, usually within one working day. Deleted sites are not billed again. Refunds are covered by our refund and cancellation policy.

8. Your content and backups

Your content remains yours, and you are responsible for it and for having the rights to publish it. You allow us to store, copy and serve it only as needed to provide the service. We keep nightly backups for 14 days to recover from failures, but you should keep your own copies of anything important. When a site is deleted its live data is removed; backups already taken expire after 14 days. When an account is closed, its data is deleted 30 days later.

9. Complaints about content

If someone tells us that content on your site is unlawful or infringes their rights, we may ask you to respond, and may remove or disable access to it, as the Electronic Communications and Transactions Act provides for service providers. We co-operate with lawful requests from authorities.

10. Availability

We work to keep sites available and fix problems quickly, but we do not guarantee uninterrupted service. Planned maintenance is done at quiet times where possible.

11. Liability and indemnity

To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect losses such as lost profits or data. You indemnify us against claims by third parties, and the reasonable costs of dealing with them, that arise from your content or your breach of these terms. Nothing in these terms limits rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act where they apply.

12. Changes and law

We may update these terms. We tell you in your account, and by email where we can, before changes take effect, and ask you to accept them when you next sign in. These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
